Central Administrative Tribunal also known as CAT was set up for settlement of disputes arising with respect to recruitment of persons appointed for public services and also for matters pertaining with the affairs of Union under the control of Government of India.
National Consumer Disputes Redressal Commission is also known as NCDRC was established under the Consumer Protection Act, 1986 which establishes the jurisdiction and the method to appeal under the Act.
Recently, the Supreme Court wanted to know about the vacancies to be filled up with CAT and NCDRC and directed Attorney General K K Venugopal to look into the matter. Senior Advocates of Bar Associations informed that there were 36 vacancies and the NCDRC strength would be cut down by four. The Attorney General also been asked to take instructions on the rule of the method of appointments and also about the continuation of the present members of CAT and NCDRC for a period of three months till the post for the job has been closed.
The Supreme Court attached all the petitions pertaining to the alterations which were brought by the Union Government in Finance Act, 2017 as it involved with tribunals’ independence and also interfered with the appointment of chairmen and members. This was because of the Ministry of Finance who had drafted the rules of various tribunals had made a blunder under the Finance Act, 2017 which had affected the terms and conditions of 19 tribunals which also included the NGT. There were many PILs filed which contended about the decision which was struck down at a grass root level due to the interference with the orders. The PIL’s had accused the power of the Central Government which affected the functioning of the odd tribunals. It was also brought to light about the unguided power and excessive delegation to make service rules as per Section 184 of the Finance Act, 2017 which has reduced the qualification of the NGT Chairperson. A Comparison was made between the old and the new act where earlier in order to be an NGT chairperson, the person must have been a Judge of a Supreme Court or Chief Justice of a High Court but now a non-judicial member or an expert member can become a NGT chairperson.
