The Supreme Court on August 31, 2018 stayed the construction activities in a few States and Union Territories, till the policy under the Solid Waste Management Rules, 2016 has been framed. This direction has been issued due to the delay in formulating the policy.
It has been further observed by the Court that the states should frame a policy keeping in mind the interest of people and hygiene and that the delay of two years in making a policy points out to the pathetic attitude.
The issue has arisen while the Court heard a petition wherein a seven-year-old kid died due to dengue in 2015. According to the reports, the child was denied treatment by five private hospitals and his parents committed suicide. During the hearing of the petition, the Court was informed about the rise in such diseases due o poor management of solid waste.
The Court thus found out that more than two-thirds of the state have not complied with after the notification of Solid Waste Management Rules, 2016.
During the hearing, the it was stated that few states have either failed to file an affidavit after the order or they had failed to frame the policy. Fine has been imposed on the State of Andhra Pradesh for not filing an affidavit. It was further highlighted that no one appeared on behalf of the State and the Centre was not even aware of the policy. The amount of fine imposed upon the states has been directed to be utilized for Juvenile Justice Issues. The matter has now been listed for further hearing after the court stayed the constructions.
