The Supreme Court dismissed the Special Leave Petition and stated that the Section 6 Suits is of summary nature and no appeal shall lie against it.
A suit under Section 6(3) of the Special Relief Act, 1963 was filed by the Punjab Agricultural University to seek the recovery of possession from Jaswanth Singh. Decree had been passed by the trial court in this regard. Jaswanth Singh filed an appeal before the first appellate court and before Punjab and Haryana High Court but his appeals were dismissed on merits.
The Supreme Court dismissed the Special Leave petition and expressed surprise towards the fact that under Section 6 sub section (3), appeals which have been filed has been heard and disposed off on merits. It observed that under Section 6(3) of the Special Relief Act, 1963 remedy which has been provided is summary in nature and therefore no appeal can lie whereas, in the present case, two appeals have been filed by Jaswanth Singh which have been heard and dismissed on merits.
