The Supreme Court was disappointed with the neutral stand taken by the Central Government in Navtej Singh Johar case, in respect of the validity of Section 377 IPC. The Central Government, in the case filed an affidavit leaving the matter to the wisdom of the Court. Justice D Y Chandrachud said that this means that the government has no view of its own.
The counsel appearing on behalf of the Central Government, requested that the court should confine itself to the matter that if homosexuality should be criminalized and it should abstain from issues regarding civil rights of sexual minorities.
Justice Chandrachud held that it would have appreciated a view by the Central government in this regard and that it is the duty of the Court that the issue must be addressed. He further remarked that the court should not forget that ‘flattery is the graveyard of the gullible’. He questioned why politicians’ handover the power to judges.
Justice Nariman further issued a direction
With such developments, there is a ray of hope that the government will show commitment to the cause of sexual minorities by following the directions of the Court.
