Indian judiciary faced the most bizarre practice ever. Charges against accused got framed on a social messaging app ‘WhatsApp’ through a voice call. This came from lower court judge of Hazaribagh court in Jharkhand.
Accused in this case were two politicians Yogendra Sao and his politician wife Nirmala Devi, involved in rioting case of 2016. These accused were granted bail by top court upon a condition that they will stay in Bhopal and will not enter Jharkhand except to attend the court proceedings. Later the accused told the apex court that the trial judge despite them raising objections framed charges against them through a WhatsApp Call.
The commented on the position in Jharkhand and said that the process cannot be allowed, since the administration of justice cannot be brought to disrepute.
State counsel was lashed out by the bench and they termed this kind of any trial as a JOKE. A notice was issued to the state counsel as the accused sought transfer of case from Hazaribagh to New Delhi and asked them to respond within two weeks.
State counsel defended the WhatsApp act and pleaded that the accused repeatedly violated the conditions of bail due to proceedings in this case were being delayed. The act was still not considered valid by the court as there are different legal options when such thing happens.
The counsel of the two accused specified the fact that the trial was supposed to be carried on video conferencing but due to low connectivity in Bhopal the trial judge did it on WhatsApp.
Around 21 cases were pending against the Sao and 9 against his wife. And as the concerned case was filed when they were lawmakers, so the case was expected to be transferred to New Delhi special court that deals with cases related to politicians.
