The Central Government has sent a letter to the Chief Justice Dipak Misra asking his opinion on who is to be elected as the next Chief Justice. The hidden question here is whether there would be a change of convention and that whether there would be someone else recommended by the acting Chief Justice other than the senior most Judge Justice Ranjan Gogoi.
Chief Justice Dipak Misra is set to retire on October 2. He has to name the next person in row in the last working month. There is an expected reply from him in a few weeks. Normally the senior most Judge gets appointed to the post of Chief Justice. The question is whether the tradition would break this time or not. There were two previous occasions when this long term tradition was broken. One was when Justice AN Day was appointed as CJI in April 1973 superseding three senior most judges and also when Justice MH Beg was appointed in 1977 superseding senior judge HR Khanna.
