Social activist Sudha Bhardwaj will not be taken out of Haryana till August 30 . The Chief Judicial Magistrate recalled the earlier order of transit remand to Maharashtra Police. This was made in response to the directions of the Punjab and Haryana High Court and the Habeas Corpus petition filed on her behalf. At 7:40 on the CJM had given transit remand to Sudha Bhardwaj so that she can be taken to Pune for her alleged linkages with the Maoist link in Bhima – Koregaon violence. The CJM recalled this order after a hearing that took place in his house at midnight.
After the arrest from her Haryana residence, a Habeas Corpus was filed on her behalf in the Punjab and Haryana High courts. The petition sought release from her illegal custody. The notice of motion was issued for August 30 and till then she was directed to be kept in house custody on the orders of Justice Arvind Singh Sangwan of the High Meanwhile she was taken to the Airport by Maharashtra police. As soon as the order came she was taken to the CJM filing an application to issue further order in compliance with the direction of High Court. This led to a dramatic session and finally the CJM recalled the earlier transit remand.
The CJM also noted that is more justified to recall the earlier transit remand to enable compliance with the second direction of the High Court. The CJM thereafter, directed Station Home Officer, Surajkund, to keep her at home at the Badarpur Border from where she was initially arrested under supervision till August 30.
Sudha Bhardwaj is a human rights activist and a visiting faculty at NLU Delhi and also the Vice President of PUCL. The arrests of the five social activists have raised an uproar in the country. They shave allegedly been arrested for their Maoist links in the Kuregaon violence. The arrests have been condemned across the country by the people and other activists. The other activists are Vernon Gonsalves, Gautam Navlakha, Varavara Rao, Arun Ferreira, Kranthi Tekula.
