The Supreme Court stayed the order passed by the Patna High Court last month in the MuzaffarpurShelter home wherein the High Court had directed Special Director, CBI, New Delhi to probe into the case and it was left open to him to constitute a fresh team for further investigation. The Apex Court comprising Justice Lokur and Justice Gupta was of the opinion that changing the investigation team could be detrimental at the current stage. The High Court headed by Chief Justice Mukesh R. Shah and Justice Ravi Ranjanhad complained about the quantum of work that’s till needs to be done.
They said that too many investigations are pending and further delay may affect the merits of the case. It noted that after considering the status report of the investigation it was best if it was carried out by the Special Director of CBI, New Delhi. He would be free to constitute a fresh Committee. Ms Prakritita Sharma was appointed as amicus curiae who would be aided by the Bihar State Legal Services Authority and she would visit the places where the victims are lodged to carry out interaction with them. The state government was asked to submit a detailed report on the number of shelter homes run in Bihar by NGOs and about the particulars of their financing. The state was also asked to record the particulars of those shelter homes run by Government as well. It was by a report of the Tata Institute of Social Sciences team that was conducted and prepared on April 26, that the startling revelations about the physical and sexual abuse of the girls was highlighted. The police barged in and Nitish Kumar was prompted and forced to bring in the CBI.
