Deputy Chief Minister Manish Sisodia, AAP MLAs Amanatullah and Sanjeev Jha and others were discharged by a Delhi Court in relation to a protest held by them outside the Tihar jail in 2014.
Stating a delay of four years in filing the charge sheet against the accused without any valid reason, Additional Chief Metropolitan Magistrate Samar Vishal granted relief to the accused.
The court, while considering the submissions made by advocate Mohd Irshad, who was appearing for the AAP leaders, noted that there was no allegation that any of the accused personswere absconding or hiding in the case. The court also noted that as per the police record itself, the primary investigation finished within a few days of the incident itself.
The matter relates to the protest staged by the members of AAP after their convener Arvind Kejriwal was taken into judicial custody for refusing to present a bail bond of Rs. 10,000 for a defamation case, filed by BJP leader Nitin Gadkari. Kejriwal was sent to two-day judicial custody by a Delhi court in May 2014, in protest of which party members and AAP supporters clashed with the police outside Tihar jail.
