On Wednesday 19th September 2018, Mr. NandanNilekani was appointed by the Supreme Court for conducting the examination of an artificial intelligence based or computer based technological solution for inspection of medical colleges by the Medical Council of India (MCI).
Initially, the petition, filed by private medical colleges, before the court was denied permission to admit students in M.B.B.S Course for the academic year 2017-18 by the Centre. In the petition, the petitioners had contended that they were denied permission, despite the Centre being unable to find any deficiencies. The Court, in September last year, allowed the petition considering the presence of negligible deficiencies, while stating that it was high time some deterrent measure is laid down,for the colleges and the state authorities, to prevent them from doing such acts which generate such last-minute litigation.
Afterwards, an endless number of disputes were raised, pertaining to the question of what actually transpired at inspections of various private medical colleges by the MCI. It was suggested by Amicus Curiae Kapil Sibal for employing a computer network based technological solution, which might include artificial intelligence, which lead to the appointment of Mr. NandanNilekani. Mr. Gaurav Sharma, who was representing the MCI, supported this suggestion. Furthermore, the MCI was requested to hold a meeting with Mr. Nilekani, Mr. Sibal and any other counsel having any interest in the said matter, within 15 days, either in New Delhi or at any other place in India. Mr. Sibal will be expected to chair the said meeting. Mr. Sharma was also directed to prepare a written note containing the issues that needs to be highlighted, so that they can be taken up by Mr. Nilekani to provide solutions. It was left for Mr. Nilekani to decide if they needed assistance from various IT companies like Wipro, Infosys, Accenture, etc. for presenting appropriate suggestions before the court. The matter has now been listed after a period of six weeks for further hearing.
