The Supreme Court sought the opinion of Attorney General, KK Venugopal on a plea filed by the administration of Jammu and Kashmir, seeking the decision of the Court to appoint Dilbagh Singh as the Acting Director General of Police (DGP). The bench further directed that the copy of the application must be served to the amicus curaie however, it did not disturb Singh’s appointment.
A petition was filed in the by the State, wherein it sought exemption from following the guidelines laid down by the Apex Court in Prakash Singh’s Case, where minimum tenure of two years has been prescribed by the DGP, irrespective of the date of superannuation. Relying on this judgment, the Supreme Court restrained all states from appointing acting DGPs, as there is no concept regarding the same.
