The Supreme Court has held that due to the increasing misuse of the anti-dowry law, the parliament now has an obligation to formulate a law protecting husbands and their relatives preventing the social disaster which may lead to more complicated problems in the society.The Court has revised a 2017 judgment that had sought to prevent the misuse of the anti-dowry law. The previous judgment had suggested the formation of a family welfare committee at the district level to look into complaints before arrests were made in dowry cases but the SC has held that formation of such a committee is beyond the reach of law and will further delay the adjudication process.
The SC has stated that though the intention of the law is good, however, sometimes the law enforcement agencies have been over-enthusiastic in applying the same. In this regard, the Court has said that the over-enthusiasm of police for arresting husbands in such cases may lead to causing a war between the two sexes.
The Court has stated that it is an obligation on the part of the legislature to frame laws protecting people against the misuse of the anti-dowry law. It has said that it is the obligation of the courts to assess the genuineness of the complaints and evidence before coming to the conclusion of arresting the accused in such cases.
