The Delhi High Court has granted permission to the Central Bureau of Investigation (CBI) to file a closure report in a case concerning the disappearance of Najeeb Ahmed, a JNU student, nearly two years ago. The verdict was given on a petition filed by Fatima Nafees, Ahmed’s mother. During the last hearing, CBI had informed the court that they have not been able to find any evidence of Ahmed being assaulted a day before he went missing. While accepting the contention, the HC has now ruled that Fatima can raise her grievances before the trial court, where the closure report is being filed.
According to Fatima’s petition, 27 year old Ahmed was studying MSc. Biotechnology (1st Year) at Jawaharlal Nehru University. On October 15, 2016, he called her at around 2:30 am in the morning and informed her that something had happened to him.Worried, Fatima left for Delhi with her second son Mujeeb and upon reaching Delhi, called her son again and told him that she will be coming to his hostel room to whichNajeeb confirmed that he was still at his hostel. However, upon reaching her hostel room, Fatima discovered that her son was missing. She also found out from other students that Najeeb was beaten up by members of the ABVP on October 14. On October 16, an FIR was registered after to the disappearance but there was no mention of the assault on Najeeb.
The petition now submitted that members of ABVP assaulted Najeeb, and since ABVP is affiliated to the RSS, it gets connected with the ruling party, BJP as well. It had therefore reasoned that the HC should appoint a SIT, consisting of members with proven integrity from outside Delhi to take over the investigation from Delhi Police crime branch.Thereafter, in May 16 last year, the CBI took over the probe from the Delhi Police and later informed that they have decided to file a closure report in the case as its investigation did not reveal any offence been committed against Ahmed. To this, Fatima asserted that it was a political case, as a consequence of which the CBI has succumbed to the pressure of its masters.
On September 4, after hearing both the sides, a Bench, comprising of Justice S. Muralidhar and Justice Vinod Goel, then reserved its verdict.
