On Wednesday, the Supreme Court bench, comprising of Chief Justice Dipak Misra, Justice D. Y. Chandrachud and Justice A. M. Khanwilkar, dismissed the writ petition of Quo Warranto, filed by Advocate R. P. Luthra, challenging the elevation of Justice RanjanGogoi’s as the next CJI. Holding the basis for filing the petition as unprecedented, the petition was heard and dismissed by the Chief Justice.
The petitioner-in-person then questioned the presence of Chief Justice Misra, as he was the respondent number 2. In response to this, the Chief Justice said that a writ of quo warranto could be a letter which was later taken up by the court, but since the court found no merits, the court dismissed the matter.
Refusing to relent, Mr. Luthra requested the bench to determine whether this bench is suitable for hearing this petition or not and then whatever decision is taken will be accepted by him.
When the advocate raised his voice during the brief course of hearing, the CJI remarked that “calmness is more of interest than anything else and asserted Mr. Luthra to accept the order gracefully as his writ of quo warranto is devoid of merit.
