Directions were issued by a bench, comprising of CJI Dipak Misra, Justice AM Khanwilkar and DY Chandrachud, after a litigant, arrested for allegedly making derogatory remarks against the famous Konark temple, moved to the apex court seeking regular bail as the lawyers of the Orissa HC were on strike since August 29 due to a “rift” between the members of police and bar association.
The Delhi-based petitioner was granted interim bail in the aid matter from a Metropolitian court and moved to the apex court for regular bail. The bench then extended the interim relief granted to the petitioner, Abhijit IyerMitra, till 5th October so that he can approach the Orissa HC.
Furthermore, the Apex Court restrained the Orissa High Court Bar Association and other connected associations to go on a strike and directed them to resume their court work to avoid causing any impediment in the right of access to justice of any litigant and so thatany petitioner can file appropriate application before the High Court to protect their liberty and agitate their grievances. The apex court also directed the Director General of Police of the state to transfer the investigation of the cause of the rift between police and the lawyersto the Inspector General of Police (Crime Branch), who shall probe the matter with the assistance of the Superintendent of Police.
The court also asked the Inspector General of Police to consider any request of police assistance made by the petitioner.
