On Thursday, the Uttarakhand High Court directed implementation regarding the ban on pornographic websites, non-compliance of which will lead to suspension of licenses of Internet Service License Holders.
Observing the notification issued by the Centre in 2015 in this regard, a bench comprising of Acting Chief Justice Rajiv Sharma noted that even though the directions were issued to all the Internet Service License Holders, but the same hasn’t been complied by all the Intermediaries till date. The sites are still available to the children to view indecent and obscene acts, including pornography. It was expected from all the Internet Service License Holders to block such sites and protect the children of an impressionable age from getting affected.
The court took suomotu cognizance of the news reports pertaining to the gang rape of a minor girl in a boarding school in Dehradun. In the said incidence, it was noted that the school management, instead of taking prompt action against the culprits, was trying to hush up the matter. However, FIRs were registered and the four accused were charged under Section 376 and 201 of the IPC and POCSO Act, 2012. Noticing the increase in such instances and according to the news reports, the accused boys watched a pornographic movie before sexually assaulting the minor girl.
Thereafter, the court noted that the Ministry of Communication & IT, Department of Telecommunications, Government of India, in July’i5, had issued a notification banning pornographic websites. Observing the absence of implementation of the directions on the notification, the following directives were issued:
