The Uttarkhand High Court issued a number of directions for welfare if the transgender people in State. The bench comprised the Chief Justice of the High Court, Rajiv Sharma and Justice Manoj Kumar Tiwari directed the state to formulate a scheme within six months to provide reservation in admission in educational institutions and also for public appointment of transgender people. The court in this case was hearing the petition filed by two transgenders Rank and RajniRawat Kumar, who had sought protection of their lives and protection of liberty. The court took general judicial notice of the difficulties faced by transgender population in the country. It took note of the Supreme Court Judgment in the case of National Legal Services Authority v Union of India, where the Central and State Governments were directed by the court to recognise transgender people as third gender and also provide them with educational and social benefits.
There were a number of points over which the court lamented. It said that unfortunately no steps have been taken by the government to give the transgender people place in employment and educational institutions. No proper measures have been provided for medical care or social welfare. The Court also noted that no transgender people must be separated from the family on account of being a transgender.
