In the course of hearing of appeal filed by the Airport Authority of India (AAI), A Gujarat High Court bench comprising of Acting Chief Justice AS Dave and Justice Biren Vaishnav denied delivering any sort of permission to the AAI to relocate or shoot the stray dogs. Allegedly, the stray dogs which enter the operational area of AAI pose a threat to the safety of passengers and aircraft during take-off and landing, by the words “Under no circumstances, this Court can permit the appellant/petitioner authority to shoot dogs…”
AAI had based its arguments and reasoning on the provisions of Gujarat Provincial Municipal Corporation (GPMC) Act, 1949 which requires the Municipal Corporation to ensure public safety, health and convenience, further stating the problems of stray dogs in their Action Area. The judgment in Airports Authority of India v Municipal Corporation of Greater Bombay was referred. This judgment by Bombay High Court allowed the petitioner to kill stray dogs in “emergent circumstances”.
The petition was, however, dismissed furthering that the appellant can pursue the respondent Corporation to enter into such discussion and deliberation for resolving such an issue.
