The Supreme Court bench comprising of Chief Justice Ranjan Gogoi and Justice S K Kaul issued notice to the Enforcement Directorate(ED) on Vijay Mallya’s plea challenging the ongoing proceedings in a Mumbai Court to declare him as a fugitive economic offender. The bench has refused to stay proceedings before the Mumbai Special Court.
To further clarify, under the provisions of the Fugitive Economic Offenders Act, once a person is declared a fugitive economic offender, the prosecuting agency has the powers to confiscate the accused person’s properties.
The notice was issued while the said bench was hearing the Special Leave Petition preferred by Mallya against the order of the Bombay High Court wherein the bench had rejected his pray to stay proceedings under required provisions of the Act till further orders of the Appellate Tribunal under the Prevention of Money Laundering Act(PMLA) in the Appeals filed by SBI and 11 other banks.
In September, the liquor baron had told the PMLA Court that “he was not a fugitive economic offender” and not involved in the scheduled offence of money laundering. Mallya approached the Apex Court after the Bombay High Court and the PMLA Court rejected his plea.
