The Convict in the case, famously known as Tandoor Murder Case, would have murdered his wife and attempted to burn her body parts in a clay oven or at a restaurant, and the same led to his imprisonment. In 2013, the convict was sentenced to death which was later, given his clean history, reduced to life imprisonment by the Supreme Court.
The Convict in the instant case has been undergoing the punishment in Tihar jail since 1995. The Hon’ble Bench of the Supreme Court comprising Justice Siddharth Mridul and Sangita Dhingra Sehgal passed an order for the immediate release of Sushil Kumar. The Delhi Government’s refusal for his early release had him approach the Delhi High Court, wherein Senior Advocate N Hariharan contended that he has been kept behind the bars ‘illegally’. In the prior hearing, the court questioned the reason behind the refusal for early release and indefinite detention of the convict. Subsequently, the court became aware of the rejection of plea for his early release by the Sentence Review Board.
Henceforth, the convict with the legal assistance of his advocate Amit Sahni approached the Hon’ble High Court of Delhi for justice. The learned counsel contended that the imprisonment is illegal because the convict already served 25 years, which is the maximum prescribed period and mandated by the Board.
