The Delhi High Court has officially abolished Beggars Court, four month after its landmark ruling abolishing beggary as a criminal offence in the Capital City of Delhi via a Public Notice dated December 20, read as follows, “The MM (Beggars Court), Central, Kingsway Camp, Delhi stands abolished”.
The division bench comprising of Justices Gita Mittal and C Hari Shankar struck down the anti-begging provisions as unconstitutional stating that begging is “wrong approach to deal with the underlying causes of the problem”, asserting “It ignores the reality that people who beg are the poorest of the poor and marginalized in society. Criminalizing begging violates the most fundamental rights of some of the most vulnerable people in our society.”
The public notice issued has also notified the transfer of 11 judicial officers namely, Shelly Arora, Vijeta Singh Rawa, Saumya Chauhan, Harvinder Singh, Arun Goel, Ajay Kumar Malik, Richa Parihar, Preeti Parewa, Sawti Sharma, Prigya Gupta and Gopal Krishan, with immediate effect. The order further specifies that in order to save litigants and lawyers from inconvenience due to such transfers, the concerned District and Sessions Judge will have to ensure that proper track is kept about the movement of cases from transferor court(s) to transferee court(s) and that the cases transferred has to be duly notified on the website of District Courts as well as outside the transferor court(s).
