The Delhi High Court has asked the Delhi Police Crime Branch to lodge an FIR against its official, who in 2013 had certified that real estate baron Sushil Ansal was clear of any criminal case which led to issuance of a travel document to the convict. It was observed that Sushil Ansal, convicted for the 1997 Uphaar Cinema Fire incident that claimed 59 lives, misled the Indian government and misrepresented on oath regarding his conviction when he applied for a passport in 2013 under tatkaal scheme.
The HC was hearing a plea moved by the Association of Victims of Uphaar Tragedy (AVUT), through its chairperson Neelam Krishnamoorthy and general secretary R Krishnamoorthy. The chairperson has sought a CBI probe into the alleged misconduct by passport and police officials. The Court of Justice Najmi Waziri observed that the real estate baron misled the government via the misrepresentation of his status of conviction on oath and has directed the Ministry of External Affairs to carry out an enquiry against the passport officers who issued the travel document to Sushil in 2000, 2004, 2013 and 2018. The report has been asked to be submitted within four weeks.
The question was also raised in the court as to why the requirement of pre-police verification for the issuance of a passport was relaxed to post-police verification when Ansal applied for a passport. The court observed, “when Sushil applied through Tatkaal scheme, he should have given information as required. Sushil has not only misled the Government of India, but has misrepresented an oath. Appropriate proceedings against him would be warranted.”
