The Supreme Court of India issued directions to the Government to implement Standard Operating Procedure (SOP) for managing complaints respecting Child Pornography by November 15, 2018. An Anti-trafficking Non-Governmental Organisation named ‘Prajwala’ addressed a letter along with two rape videos in a flash drive to the former Chief Justice of India HL Dattu. A bench comprising Justice MB Lokur and Justice UU Lalit ordered, “The Government of India may frame the necessary Guidelines / SOP and implement them within two weeks so as to eliminate child pornography, rape and gang rape imageries, videos and sites in content hosting platforms and other applications”. The case was taken Suo Moto by the Apex Court of India.
The letter addressed to the Former Chief Justice of India emphasised on the need for a tie-up between the Ministry of Home Affairs and the messaging systems and websites. The NGO made this demand with a notion to prevent obscene videos from being uploaded and made strong appeals to the State to impart special training to tackle the Cyber-crime issues. Drawing its attention to the petition, on October 12 the apex court issued appropriate directions to the centre to decide on the SOP by November 15, 2018. Also, it stated that the centre is free to make such necessary changes and improvements after such date.
The Court said, “In any event, since these comments, improvements and suggestions from the State Governments may be a continuous process, we are of the opinion that a cut-off date must be fixed for finalizing the Standard Operating Procedure. Accordingly, we fix 15th November 2018 as the date for finalizing the Standard Operating Procedure. Of course, this does not mean that improvements cannot be made from time to time and as and when necessary.”Having been told the measures taken by the Centre in relation to the matter stated herein, including the launch of a cyber-crime portal and finalisation of an SOP, the Apex Court scheduled the next hearing to the month of February 2019.
