The Supreme Court bench headed by CJI, Ranjan Gogoi stayed the Meghalaya High Court order directing all commercial operators and the aviation ministry to urgently take a decision to start flights from Umroi Airport. As a fact, Umroi Airport is 30 km from Capital city Shillong.
Senior Advocate Mukul Rohatgi, appearing for IndiGo Airlines, made submissions that there were no Fire Fighting and other facilities available at the Umroi Airport which is why flight operations should not and cannot be started immediately. The decision to stay the order by the three member bench headed by CJI and comprising of Justices S K Kaul and K M Joseph was made with respect to this submission. The matter was mentioned on Wednesday by the senior lawyer stating the urgency of the matter as expressed by his words, “It relates to a suo motu order passed by the Meghalaya High Court that the airlines and the civil aviation authorities must give a date to start the commercial services. There is no petition. No papers. The airport is not ready. The aircraft cannot land, no slots, no fire fighting!”
The Apex Court was told that the High Court on its own had last week taken up the matter and asked the Director General of Civil Aviation, Secretary, Ministry of Civil Aviation and Airport Authority of India, Chairman to hold a meeting within a week on the issue of making the airport operational.
