A S. Sainaba, President of National Women’s Front (NWF), had filed a defamation complaint against Editor-in-Chief of Times Now, Rahul Sivashankar and then Senior Editor of the same channel, Anand Narasimhan because of the show titled “Hindu girls are hunted, converted, exploited in Kerala” which alleged that a NIA report had found her to be persuader of Hindu girls to embrace Islam. She had further contended that the show was trying to connect her with the matter of “love- jihad” and that the publishing of such a report or show was highly derogatory in nature. She claimed that the show wrongly accused her of playing a major role in the conversion of women to Islam and providing them a hideout or shelter. The matter is before a Judicial Magistrate Court in Malappuram.
On this, the accused have approached the Kerala High Court demanding dropping of proceedings against them. They have advanced the allegation that the Magistrate took cognizance of the complaint without prosecution of sanction as envisaged mandatory under Section 196(1A) of the Code of Criminal Procedure. The petition also alleges that Sainaba has approached the Court while the matter of religious conversions of two women is under investigation. On individual capacity, the petition advances the absence of knowledge or authority to decide on the contents of the show on part of Mr Narasimhan and reasonable verification of the contents of the report by Mr Sivashankar as legally valid defense.
