The Supreme Court of India has passed on of the significant orders catering to the fact of protecting the reinstating rights immediately. However, it was duly mentioned that The Supreme Court on Tuesday set aside the October 23 orders of the Central government and the CVC and had set aside and concentrated on the reinstating and divesting CBI Director Alok Kumar Verma to his post.
Chief Justice Ranjan Gogoi has played a significant role in the authoring of the judgement. Though Verma will not be eligible to take decisions of higher accordance or matters related to important policy making, this process would continue and will be tried under the provisions of Section 4A of the DSPE Act by the Selection Committee. However it is significant to note that the spirit of Vinit Narain case, 1997 could not be disregarded. The court had also mentioned that the interpretation of the word ‘transfer’ as used under the provision of section 4B of DSPE Act could not be comprehended in a traditional spirit and must be read in an independent spirit as mentioned by Justice Kaul.
A pivotal role has been played by Senior Counsel, F S Nariman, who is appearing for Verma catered to the fact that without any previous legal sanction it was argued that the CBI director cannot be removed by High Powered Committee under the provisions of Section 4(1) of the Delhi Special Police Establishment.
It was on November 16 that a ‘mixed’ enquiry report against Verma was submitted by CVC.Attorney General has duly mentioned that the fight between the two officers namely Verma and Special Director Rakesh Asthana led to the inception of everything. The court had also asked for a significant reason for the ‘october 23’ event.
Asthana has been alleged of bribe which he has challenged and has approached Delhi High Court. Alok Verma, was appointed for the position of CBI Director on January 20, 2017 and with this regard the role of the NGO named Common Cause has played a significant role by filing the PIL against removal of Verma from office. It was mentioned that since Verma would handle sensitive cases he is subjected to
"being victimised for taking action against Mr. Rakesh Asthana, a Gujarat cadre officer and also for entertaining complaint against the top functionaries of the present government".However, the significant part is that Verma’s petition and PIL were heard and had orders reserved for the same.
