The political and socio -religious dispute in India that’s been going since 1992 is up for next hearing on 10th January 2018 by a newly formed Constitutional Bench. In a surprise development in the Ayodhya dispute the Supreme Court bench headed by Chief Justice of India Ranjan Gogoion 4th January ordered formation of new 5 judges Constitutional bench under his headship only for the sole purpose of hearing the Ram Mandir dispute case.
The 2010 verdict of the Allahabad HC which directed dividing the land in 3 equal portions – 2.77 Acres each was challenged in SC in the year 2011. Total of 16 appeals and petitions have been filed till date in the SC against the Allahabad court’s 2010 verdict. Recently in a petition filed byAkhil Bharat Hindu Mahasabha (ABHM) rquesting urge hearing of the Ram Mandir land dispute was dismissed by the CJ. CJ further added that he had already passed an order in October 2018 as to hearing the case in January 2019 and that this case was not of so importance.
On the importance of the issue involved the CJ has power and may on its discretion under Supreme Court Rules, 2013 appoint any number of judges for hearing a matter however subject to condition of minimum 2 judges. The SC’s website displayed the details of the new bench so formed. The bench consists of Chief Justice Ranjan Gogoi, Justice S A Bobde, Justice N V Ramana, Justice Uday Umesh Lalit and Justice D Y Chandrchud, JJ. The matter is up for hearing at 10.30 AM on 10th January in the Chief Justice’s court.
Advocate Ezaz Maqbool representating the petitioner M Siddiqi and ors said that he was surprised to see that the Chief Justice has constituted a 5 judges bench for hearing the matter. He further added that he had been expecting a 3 judge’s bench to be formed for hearing of the Ayodhya land dispute.
