The controversy that begun in year 2017, within the top investigating agency of the country is still in the news and has not taken rest. The dispute that arose in the year 2017 on the decision of central government for appointment of Rakesh Asthana, as special director in CBI was opposed by the CBI director Alok Verma. The heat of the controversy within the agency became hotter day by day resulting in disturbance of country’s peace. The appointment of Rakesh Asthana was challenged in SC in the year 2017. Allegations of being corrupt and being involved in scams were put on CBI director Alok Verma by Rakesh Asthana.
The controversy took a sharp turn on 23rd October 2018 when the central government in its order through Department of Personnel Training and Central Vigilance Commission issued and order of relieving Alok Verma as CBI chief. The order also consisted an order for appointment of M Nageswar Rao a 1986 batch IPS officer as interim chief of CBI. This order of the government was challenged by Alok Verma in SC of India. Alok Verma also pleaded for quashing of the three orders of 2018 by the central government and CVC. SC further asked the CVC to complete its probe and submit a report in SC within 2 weeks.
On 8th January 2019, CJ Ranjan Gogoi on behalf of 3 judges bench orderd and issued notice to reinstate Alok Verma as CBI director. The court also mentioned that there is no provision in law through which the government can exercise its power to divest a director of top investigating agency of the country. The court further said that Alok Verma cannot make major policy decisions until the committee so formed submits its report within the time frame. The court gave special order for formation of a committee under Section 4A(1) of the Delhi Special Police Establishment Act (DSPE Act) to complete the probe and submit its report as to if Verma to be appointed as director of CBI.
The committee so formed to be consisted of leader of opposition, PM and SC’s judge. The SC appointed its second most senior judge, Justice A K Sikri to be in the panel of th committee. Now the committee thus formed consists of Prime Minister Narendra Modi, Opposition Leader Mallikarjun Kharge and Justice A K Sikri of Supreme Court. The Committee is likely to submit its report by 10th January 2019.
