The Ministry of Environment and Forests (MoEF) entitled to get information regarding of all the captive elephants.
The SC on Friday directed the Chief Wild Life Wardens of states to find out the age of all the captive elephants and provide that information to (MoEF).
Supreme Court issues notices to 17 states on welfare of captive elephants, the states names are Andhra Pradesh, Assam, Bihar, Goa, Karnataka, Kerala, Madhya Pradesh, Maharashtra, Manipur, Meghalaya, Nagaland, Punjab, Rajasthan, Sikkim, Tripura, Tamil Nadu and West Bengal.
The bench of Justices AK Sikri and Abdul Nazeer was acting on a petition filed by an NGO Wild Life Rescue and Rehabilitation Centre which among others, seeks implement the provisions of the Wildlife [Protection] Act, 1972 and the Prevention of Cruelty of Animals Act 1960 to protect the captive elephants.
A prayer related to this move that census should provide all the captive elephant under the supervision of (MoEF) and should hire the independent experts.
An application has been filed by Sangita Iyer, a journalist and Wildlife filmmaker that how these captive elephants have been treated for the purpose of exhibitions. She has also said that there should be ban on exhibition and parading of captive elephants.
The journalist has further mentioned in the petition that Kerala has almost 21% of India's captive elephant population and they are treated very brutally with full of cruelty. The elephants had had hear the sound of fireworks which causes stress and anxiety. Keeping in the animals in this surrounding are not adapted for their survival.
In 2014 when the journalist filed the petition, during the Trissur Pooram Festival, at the same time she was making her documentary film "Gods in Shackles" she witness so many blind and wounded elephants who were treated badly.
According to the petition, it is impossible to exhibit and parade elephants in public without inflicting cruelty beyond description on them. Therefore, the petition seeks to prohibit exhibition and parade of elephants.
