Justice Sikri will be retiring from the Supreme Court on March 6 and the central government has decided to nominate Justice AK Sikri as president/member of the London based Commonwealth Secretariat (SCAT) Arbitral Tribunal. But Sikri has withdrawn his consent for the post. The justice has been criticised for voting along with the PM Mr.Narendra Modi in the ouster of the CBI Alok Verma in the high level committee that he was a part of. Critics of the justice has stated that he had earlier accepted this post retirement position from the government the justice has now said that he will not accept the position in London and will not be accepting any post retirement jobs either.
Justice Sikri has also written a letter to the Law Ministry to formally with his consent about his selection as a member of the (CSAT).
Further, Justice Sikri has stated that appointment to the CSAT is not an assignment on regular basis. There is no monthly remuneration for the same, as there are only two or three hearings a year.
By the Commonwealth government in 1995 the (CSAT) was established after agreed upon some statute. The main purpose was to fulfill the requirements of the agreed Memorandum on the Commonwealth Secretariat (1964) and this was revised in 2005 by the government.
The CSAT consists of 8 members among them one should be a President and other seven are the members. Commonwealth Government has to select the members on a regional representative basis. The members should have high moral turpitude and who must hold or held high judicial office in a Commonwealth country. The terms of appointing the members are 4 years and they may be renewed only once.
