Everyone is well aware of the Gujarat riots in 2002. The riots were caused because of burning S-6 Coach of Sabarmati Express. Zakia, the wife of ex-MP Ehsan Jafri who died among the 68 victims of riots, has approached the Supreme Court challenging the Gujarat High Court order dated October 5, 2017, which ignored her plea against the SIT’s decision.
The Hon’ble Bench of the Supreme Court comprising Justice AM Khanwilkar and Ajay Rastogi gave, as requested by the petitioner, four weeks time to list the matter. The Court said it would consider the application by social activist Teesta Setalvad for becoming co-petitioner in the case. The learned counsel appearing for Jafri contended that notice is to be issued in the plea as it relates to larger conspiracy during February 2002 and May 2002. Further, the petitioner said that the magistrate ignored the substantial merits in the protest filed by the petitioner subsequent to the sustenance of the SIT report by the Trial Judge.
The SIT report stated that sufficient evidence was not available to prosecute Modi and other senior government officials, thereby giving a clean chit to the former. The plea stated that the High Court did not consider the petitioner’s complaint which was independent of the Gulberg case registered at Meghaninagar police Station.
The High Court order said the SIT was monitored by the Supreme Court, and it partially allowed the petitioner to seek further investigation in the matter. Hence, the petitioner can approach the appropriate forum, including the magistrate, division bench of the High Court or the Supreme Court, to seek further investigation in this regard.
