A petition has been filed in Delhi High Court alleging that the trailer questions the sanctity of the former Prime Minister and defames him and portrays a bad image in the national and the international spectrum. The petition also demands a direction to Youtube and Google for taking down the trailer of the movie. The petition has been filed by Pooja Mahajan who is a designer by profession who has alleged that the trailer has violated Section 5-B of Cinematography Act and Rule 38 of Cinematograph (Certification) Rules, 1938.
It has also been mentioned that the trailer of the film has been ‘motivated’ even though the foundation of the same has been based upon Sanjaya Baru’s book ‘The Accidental Prime Minister’ but it has been pointed out that the trailer of the movie is not based upon the facts of the book. Thus, the trailer shows the office of The Prime Minister of India in a negative dimension.
It has also been alleged that under Section 416 of IPC the offence of cheating by impersonation has been committed by the actors. The trailer has also violated Youtube’s terms and policy conditions. Therefore, certificate of screening has not been granted by Central Board of Film Certification (CBFC) and it has expressed its vehement opposition. Greater emphasis has been laid down upon seeking prior permission and a no- objection certificate fromMs. Sonia Gandhi and former Prime Minister Dr. Manmohan Singh before screening the film.
It has also been mentioned that-
"Respondent No. 4 /CBFC is under statutory obligation under Cinematograph Act 1952 and Rules to judge the entire Trailer in its entirety from the viewpoint of its overall impact and should have examined in the light of country's sovereignty and integrity, country's image before entire world, as regarding unaccountable damage to the office of Prime Minister."
