The Supreme Court bench comprised of Justice U.U.Lalit and Indu Malhotra has posted to February 19 the final hearing of the string of petitions where the 2018 amendment of SC/ST act was challenged.
Besides, the review petition of the apex court which is pending from March 20 of last year in the case of Dr.Subhash Kashinath Mahajan v. the State of Maharashtra shall also be decided on the same day.
A new Section has been brought in by the way of amendment where Section 18A has been inserted in the Act of 1989, on which the court has imposed requirements of undertaking some preliminary inquiry and procuring approval prior to arrest is done and the unconditional ban on the grant of anticipatory bail has been restored if any offense is committed under the Act.
Massive unrest happened across the nation after the decision given by Subhash kashinath Mahajan resulting in the Union of Indian and several other state governments going for a review of the same. However, the bench of Justices Adarsh Kumar Goel and Lalit had refused to relent.
In a case where the Justice A.K.Sikri was heading the bench had refused to stay the Amendment, further referring the matter to Chief Justice for reconstitution of the bench. The bench also had suggested that it would be appropriate to hear the two sets of petitions consisting of challenge and review together.
Attorney General K.K.Venugopal has mentioned that Chief Justice Ranjan Gogoi stated that the listing of Centre’s review plea will be considered and petitions challenging amendments to SC & ST (Prevention of Atrocities) together before an appropriate bench.
