The Supreme Court, quashing the Rules 14A to 14D of High Court of Madras, 1970 in its judgment observed that attributing political colors to judgments is nothing less than an act of contempt of gravest form.
The bench comprising of Justice Arun Mishra and Justice Vineet Saran has observed that the Bar members are going to the media every time and are criticizing judges in person and to attribute a political color to the judgments.
The bench has stated that “Whenever any matter which is in relation to politics comes to Court and the decision is given in either way the parties with an insinuation are attributed by unscrupulous advocates. These kinds of acts are harming the Judiciary resulting in the destruction of faith among the common men towards the judicial system. If there is any genuine grievance against any judge then there is an appropriate process to lodge a complaint against the judge and the concerned higher authorities would take care of the situation but not by this way and the judges who are being attacked are not supposed to go the media to ventilate their point of view.”
It is further observed by Justice Mishra that some advocates feel they are the only the champions of causes and are above the Bar Council. “They do these acts with the hunger of cheap publicity which is not permitted by noble ideas which are cherished by great doyens of the bar. The advocates are actually prohibited according to the statutory rules from advertising and to cater to media, giving a distorted version of court proceedings which is sheer misconduct. All those tactics and those of unscrupulous elements should not influence the judgments and it should not even deny justice with ulterior motives.
The bench added that the Bar Council of India as it always does can implement some good ideas to control this scenario and it would not lag behind in cleaning process so badly required. The profession is to be made so noble by the Bar and it is completely necessary to remove those who are the black sheep’s of the profession so that the rich ideals of Bar be preserved.
