The Ministry of Labour and Employment in consultation with other ministries, which include Ministry of Home Affairs, Ministry of Women and Child Development, Ministry of Mines, Ministry of Coal and Ministry of Petroleum and Natural Gas, took a decision on employment of women in mines beyond barred time.
As per the latest Gazette Notification No. 393 ( S.O. 506(E)) dated 29 January 2019, the government exercising power under section 83(1) of the Mines Act, 1952 formulated rules for allowing the women to work in mines across the country. Previously, section 46 of the Act provided that women can work in any part of mines, whether on or below the ground, except between 7 PM and 6 AM.
The Government notification also provided for an eleven-hour interval between the termination and restart of the employment on the next working day. It also provided that the women could provide assistance in relation to technical, supervisory and managerial work. The employer has to secure consent in writing from the women employer to materialize the employment of women between 7 PM and 6 AM. Further, the employer has to provide the necessary safety facilities to those employed women.
The Chief Inspector of Mines has been authorized to formulate and implement SOP (Standard Operating Procedures) in respect of the deployment of women. An expert committee under section 12 of the Act recommended this move to the Ministry of Labour and Employment.
