It’s been months that the departmental tensions within CBI have bee continuing. From removal of Alok Verma from the post of Director to Appointment of Nageshwar Rao as CBI Director, everyone has been challenging others decisions and alleging the officials.
On 11th January 2019, current DSP of CBI – Ajay Kumar Bassi moved SC challenging his transfer orders by current CBI Interim Chief Nageshwar Rao. After removal of Mr. Asthana from the post of CBI Director, Nageshwar Rap took over the charge as CBI Interim Director on 23rd October 2018. Immediately after joining as CBI director, he cleared pending transfer orders, also including those of the officers who were probing an alleged corruption and extortion case against CBI Special Director Rakesh Asthana and others.He further also approved transfer of two more officials of the Joint Director rank.
Several of the transfers approved by Nageshwar Rao were withdrawn by Alok Verma when he rejoined on 9th January 2019 as CBI Director. However, these transfers were again affected when Mr. Verma was hurriedly sacked on 10th January 2019 by a high-powered 3 members committee.
Mr. Bassi on such transfers moved to the SC and contends that the impugned order of current CBI Director is vitiated by mala fides and non-application of mind. Mr. Bassi further asserts that transfer orders passed by current CBI director violates of the Supreme Court decision in Alok Kumar Verma vs. UOI case, where the court gave him liberty to make a representation to the officials regarding his transfer. While defending the removal of AlokVerma from CBI Director Post he further added that there were no such allegations against him that such an extreme action was taken against him.
Mr. Bassifurther claimed that he’s being victimized by the present CBI director - Shri M Nageswara Rao, who represents certain elements within the CBI, Alleging Mr. Rao he said Mr. Rao did not want him – the Petitioner to conduct a free and fair investigation in the Asthana FIR case.
