An order passed on 20th March 2018, by a division bench of which Justice Lalit was part, that there shall be no immediate arrest on any complaint filed against government servant under the SC/ST law.
Also a PIL moved in the Apex Court challenging the 2018 Amendment to the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act of 1989. The amendmentmade to the SC/ST (Prevention of Atrocities) Act restores the no anticipatory bail provision for the accused.
The Supreme Court bench headed by Justice A K Sikri said - pending review petition filed by the Centre against the apex court's 20th March 2018 verdict and the pleas challenging the new amendments made in the SC/ST verdict will be taken up together. Justice Sikri further referred the matter to the Chief Justice for reconstitution of a bench which Justice U U Lalit was a part of.
The Parliament by way of inserting a new section - 18A in the Act of 1989, opposes the courtimposed requirements of making preliminary inquiry& procuring approval mandatory prior to making an arrest under the SC/ST Act. The amendment also restores the unconditional ban on the grant of anticipatory bail in the event of an offence under the Act.
