The Supreme Court restrained Educational Institution from providing course in subject like engineering in the Distance education mode. A Bench of Justice AK Goel and Justice UU Lalit however, allowed students of 2001-2005 batch to get their degree by appearing in exam to be conducted by AICTE, but it cancelled the degree of students of subsequent batches as the deemed university was not approved from the authorities. All the achievements of such candidate shall stand withdrawn and all the fee and other expenses shall be returned by the universities.
The court reiterated its stand that a deemed university cannot offer correspondence course without getting approval from AICTE and no deemed university can give distance education from the academic session 2018-2019 unless and until it is permitted to conduct and specific permission are granted by the concerned statutory / regulatory authority in respect of such course.
The court directed CBI for investigation into the matter and to ensure that universities do not advance their commercial interest illegally. The CBI will also prepare a report and submit it to a commission appointed by the centre. The commission will have 3 members who will be eminent persons in the field of education, investigation and Administration or law at National level. The report has to be submitted within one month.
