In the court of Additional District Judge Neeraj Gaur, a junior advocate was served a show cause notice for making a recording of the court proceedings in her phone which lasted for 40-minutes and this lead to the judge to recuse himself from the case.
While the hearing was being conducted in a matter by the ADJ a reader pointed out that a junior advocate who is the associate of main counsel appearing for defendants was recording the proceedings.
When the court asked the advocate regarding the recording she responded saying no such recording was happening but when the staff checked her phone there was a 40-minutes recording.
The senior advocate stared he was not aware of such an act done by her and when court asked why the proceedings were being recorded and he said that strict instructions would be given to prevent any such actions in future but the court still filed a show cause notice against the senior and her till which the phone will be in custody.
ADJ Gaur has stated that in absence of any proper explanation such action would be of ulterior motive and it is totally against the rules as such recording is an interference with the administration of justice and is contemptuous.
Adding to which the court stated that it was an unconditional apology and Although there is no plausible explanation for the entire episode, the larger interest of justice demands that the unconditional apology is accepted. She is young in the profession and has a long career ahead.
The judge, however, recused from the case as he said, "Many unpleasant episodes have occurred in the present case. On the last date of hearing, defendant number one had cast aspersions on my integrity that were duly recorded in the proceedings. Today's episode is also not segregable from the earlier episodes.
Advocate Birender Sangwan said, "Such practice of recording court proceedings is unfortunate and seniors should apprise young lawyers to maintain the dignity of the court and the legal profession."
