The Supreme Court had issued a notice to Air India and Civil Aviation Ministry on the ground that they rejected a suitable candidate for the job of Cabin Crew only because she was a Transgender. The petitioner had undergone a ‘sex change’ surgery in Bangkok and became a woman in April 2014. The petitioner had completed her graduation in Engineering in 2000. She applied for the job of Cabin Crew from Northeast region whose vacancy was published in newspapers in July 2017. She had scored well in the written test and even got a call letter from Air India. The petitioner has attempted for the test 4 times and has still not been shortlisted for the job despite scoring well in the exam all four times. She got to know this through her sources that she is being consequently denied for the job because of her gender.
The petitioner has taken the precedent in National Legal Services Authority vs. Union of India wherein third gender was recognised. According to Article 21 everyone has a Right to life and personal liberty as per which a person has a right to choose his gender as well. The matter will be further heard on November 23.
