The SC on Monday issued the notice to the election commission of India and the UOI based on the petition seeking to decriminalize the act of reporting an allegation on the manufacturing of EVM/VVPAT. Not letting people speak about this is an infringement of Right of Speech and Expression.
The petition was moved by Sunil Ahya which was heard by the three-judge bench of SC, CJI Rajan Gogoi, Justice Deepak Gupta, and Sanjeev Khanna. The bench issued a notice to the ECI.
Ahya requested the bench to issue the writ of mandamus to the respondent, in order to set aside rule 49 MA of the conduct of Election rules, 1961 read with Section 177 of Indian Penal code, which criminalizes the reporting of deviant behavior of EVM/VVPAT because this punishes the voters up to 6 months in jail, if the complaint is not proved right.
However, this rule will make the voter hesitate to come forth and make any complaint which is an essential ingredient in a continues exercise for improving a process.
