Supreme Court has issued a notice in plea seeking strict action political parties who use religion and caste issues in the political campaigns under a writ petition. The CJI headed bench has issued notice in this petition.
A writ petition by an NRI, Harpreet Mansukhani also prayed, to constitute a committee under the chairmanship of retired Supreme Court Judges to have a close watch on entire election process and to check the loyalty of election commission. According to her section 123 of Representation of the people Act has not sufficient potential to ensure corruption free election, spokespersons/ Media representatives of political parties and other politicians those are not contesting the election use hate speeches on T.V channels and social media platform based on caste or religion line and they get easy escape from all the actions since they usually not contest an election the petitioner also argues against media houses those who use caste or religious lines for their debate shows .Communal speeches or caste remarks would be allowed any sway in election campaigns , they would vitiate the secular atmosphere of democratic life .
An appeal in the name of religion, caste, race, community or language by the spokespersons and media representatives of the political parties on T.V debate shows are normal which affect the elections of the whole country. The election commission has never taken any action against the political parties, though it is impermissible under the representation of the people Act, 1951 and would constitute a corrupt practice.
She stated “a new trend of giving tickets to those who spread communal starad or do caste based politics has grown very rapidly on media and social platform. The situation appears to be more alarming when we find such persons being elected the state assembly or parliament”.
