The Supreme Court has admitted to the appeal of Maharashtra government challenging the acquittal of Bollywood superstar Salman Khan in the 2002 hit-and-run case after 12 weeks.
A bench of Chief Justice Dipak Misra, Justices A M Khanwilkar and D Y Chandrachud said it would list the request for hearing after three months as leave has just been granted to the state government by the prior bench.
In the famous hit and Run case of 2002, an accident which led to the death of one person and injured four near Bandra in Mumbai, the trial court had awarded five-year jail term to Salman Khan. The judgement was reversed by Maharashtra High court on the grounds of lack of compelling evidence.
The state, in its appeal, had said that the High Court judgment was a complete misfortune as it chose to dispose of police’s version in entirety as well as those who were injured. The court observed that Mr Khan was not driving the offending vehicle.
The bodyguard, a police constable who was in the vehicle had suggested that the actor was driving. According to the bodyguard’s statement the actor was drunk and instead of repeated warnings chose to drive the vehicle himself.
In affidavit filed by Salman khan, he has mentioned that he is being framed on the basis of fabricated bills of the bar. He has also stated that court ignored the testimony of his friend Kamal who said that actor’s driver was at the wheel. He also complained that the proper forensic investigation of his vehicle was not done.
