In a landmark move by the Jammu and Kashmir High Court, Facebook, Twitter and Youtube have been asked to remove all publications which may have the identity of the minor rape victim of the crime committed in May 2019. The case was brought before the Bench by Amicus Curiea Farah Bashir in which she stated that five publications, print and electronic media included have violated the norms where the details of the minor child has been reported.
It was submitted by Ms Bashir that pictures, some even fake of the child victim were circulated. For the same provisions of the Protection Of Children From Sexual Offences Act of 2018, was also cited. Through this, the State government has a duty to make the general public, children as well as their parents and guardians aware of the provisions of this Act. The Court directed the Registry to show why action should not be taken under the POCSO Act. The Information Department of the place before it the report regarding the measures taken in terms of Section 44 of J&K POCSO.
The Inspector General of Police submitted that the determination of the age of the victim was still underway. On Wednesday, the Court took suo moto cognizance of the case and IGP Kashmir to file a status report by Friday.
The crime took place last week, in which a three year old girl was raped in the Sumbal area of Bandipora.As a precautionary measure all internet services were disabled.28th of May is the next hearing of the case.
This move by the Court is an example that media can be extremely detrimental to the society as well. A single act by the media can turn the life of a person upside down. To prevent the same, this action taken will help in maintaining the dignity of the innocent child.
