In an petition filed by Congress Lok Sabha MP Sushmita Dev where it is alleged by the congress party that in the last four weeks there has been as many as 40 complaints against BJP leaders for violating of ‘Model Code of Conduct (MCC)’ laid down by election commission but EC had not taken any actions on such complaints.
Abhishek Manu Singhvi, Senior advocate appearing for Congress MP has said that they have given 11 representations to EC against the PM Narendra Modi and BJP Chief Amit Shah for violation of code but it has taken decision on only two. The commission earlier has given clean chit to PM Modi for two of his speeches in Latur and Wardha where he urged voters to dedicate their votes in the name of Balakot air strike heroes, soldiers killed in the Pulwama attack and the other where he slammed Congress chief Rahul Gandhi for indicating that the Kerala constituency had more voters from the minority community.
The petitioner referred to the earlier released Election Commission's circulars prohibiting parties and candidates from using pictures of armed forces for their political propaganda and using religion. It claimed that "The purpose of all these rules and regulations is to ensure a level playing field for all candidates regardless of position, influence or ideology and also to ensure that the sanctity and integrity of the electoral process is not undermined by unscrupulous individuals".
However, pointing out the paradox in EC’s Action against the hate speeches and using of armed forces for political propaganda by BJP the congress MP claims that it is a clear violation of Article 14 and 21 of the Constitution and is also failure of commission’s duty to be a watchdog of free and fair elections in the country. Such inactions are destructive to integrity of electoral process.
The three-judged bench after hearing the petition in its order directed election commission that “The remaining nine representations of the petitioners out of 11 shall be decided by the Election Commission before we hear the matter again on May 6” and listed it on next Monday for further hearing.
