A PIL is filed before the SC under Article 32 by two lawyers to direct Election Commission for pre-ponding the time of polling during the Ramzan for the benefit of muslim voters who fast during the month. The petition prayed for pre-pontment of polling hours during the 5th, 6th and 7th phase of Lok Sabha elections which are scheduled to held on May 6th, May 12th and May 19th to 4.30 or 5.00 Am instead of 7.00 Am depending upon the administrative convenience.
The petitioner pointed out that a large percentage of voting populations, i.e. adult muslims both young and old will be fasting during the month of Ramzan and will not be consuming food or water during the day time. In the intense heat, it will be very difficult for such muslim voters to queue up at polling booths as they avoid going out in heat to possible extent so as to prevent thirst, dehydration and heatstroke.
The lawyers said that they have already filed a representation before the EC highlighting their grievances. The three- judge bench consisting of Chief justice took the matter in consideration and directed the Election commission of India to pass necessary orders in the matter.
