National Green Tribunal in furtherance to its Order dated 14.05.2019 in the matter of execution of directions dated 10.12.15 and 13.07.17 regarding the pollution of River Gangaas remedying to M C Mehta v. Union of India, pulled out the states of Bihar, Jharkhand and West Bengal.
The Tribunal stated that the failure of the authorities without any prompt and stringent action to control pollution of River Ganga, it is a danger to Environment rule of law, and damage to environment as well as the public. It also stated that the report filed by Uttarakhand with regards to Phase- I, Segment- A regarding, Monitoring Committee and 15 incomplete Sewage Treatment Plans in River Ganga, it directed Chief Secretary of Uttarakhand to monitor the matter, and submit affidavit before next date. It also stated that NMCG’s (National Mission for Clean Ganga) control over pollution has be a model for other 351 polluted rivers.
The Tribunal pointed from Water (Prevention and Control of Pollution) Act, 1974, the Pollution Control Board (PCB) must prohibit industrial activities of pollution, completely instead of allowing ot partially allowing it as of report filed by UP-PCB as Phase- I, Segment- B from Haridwar to Unnao. It also directed the Chief Secretory of UP to file the affidavit before the next date, the same is applied to Jharkhand, Bihar and West Bengal with regard to Phase- II, III and Phase- IV.
It also pointed out that there is no process and no project being completed in Bihar, only 3 off 22 being completed in West Bengal and not adequate progress in Jharkhand and also extended the deadline to Dec, 2021. It also pointed that non compliance of order for 34 years (since 1985) is a serious concern.
