In yet another case involving an artiste from the film industry, the Madras High Court granted anticipatory bail to Kamal Hassan, over his controversial remark made at a polling rally. He said that, identifying a criminal with a religion, caste or race would definitely sow the seeds of hatred among people. The bench also observed that, hate speeches had become very common in today’s day and age.
Kamal Hassan had apprehended the arrest after his comment that,first extremist of independent India was a Hindu, with reference to Nathuram Godse, who assassinated Gandhi. This remark drew outrage from the BJP, the AIADMK and other Hindu organizations. Cases were filed against him in both New Delhi and Tamil Nadu. The judge remarked that it would create hate among the people and the it was not the reason for which it was created. The judge went on to say that, even if it is an historic event, if it is not made in an proper context it would be an offence. The media was also criticized for giving importance to hate speeches and debating over them for long periods of time.The court was inclined to grant bail as the poll process was still pending and Haasan was the leader of a registered political party.
Kamal Hassan in his defence said that he had spoken only about Godse as an extremist and not all Hindus. It was also contended that, the complainant had taken certain words from the actor's speech, without verifying the contents of the speech contextually. Further, no offence was made out either under IPC sections 153(A) or or 295(A).
Lastly, it was also contended by the Public Prosecutor that, the speech has created hatred among people and 76 complaints have been registered against Hassan. He also added that, it was the duty of the police to take action against those making hate speeches.
