The Delhi High Court sought the reply of JNU on a plea by numerous female students who were seeking an early hearing on a contempt petition filed against the university and a professor accused in a sexual harassment case. The Courts have also called for the records of the main petition on the next date. In this main petition, the students have challenged the clean chit given by JNU's Internal Complaints Committee (ICC) to the professor. The Internal Complaints Committee followed the Courts order to find out whether a prima facie case of misconduct was made against the professor to suspend him from the University. One of the reasons cited for the early hearing of the petition is that, the students will not be able to complete their Ph.D. if not given access to the laboratory. In response to this, the Court had said that, the students will have complete access to the laboratory with separate keys.
In an earlier instance the Court had sought response from the police regarding the application in which the students had sought direction for the filing of charge sheet expeditiously against Johri. It was made clear that, there existed apprehension that in case of delay, the investigation will make students who are mostly scholars and other students professionally and socially vulnerable to influence and intimation by the professor. An FIR was registered and the statements of the witnesses were recorded more than a year ago, but no charge sheet was filed by the police in this regard.
It was contended by the lawyers representing the university that, the ICC had discovered that the complaints made by the students were malicious and were said to be provoked for filing such an application. It was also said that, the women were taking revenge from the professor for being a task master.
Cases like these have become a common phenomenon in India. Which party is right and who is wrong, is difficult to state without a detailed analysis of the evidence and statements. It can be hoped that a justice will be served and the offender will be punished.
