In an order of the Allahabad High Court, it acquitted a couple in a murder case, among whom, one had been given the death sentence by the trial court. Rashid @ Zakir and his wife Shakila @ Bitta were accused of the murder of three people, who were found in the factory where the couple lived. For this, the Trial Court sentenced Rashid to death and awarded Shakila life imprisonment.
In this case the High Court observed that there appeared to be a doubt in the involvement of the couple in the murders and due to this, Rashid should be given the benefit of doubt. Further, the taking place of the incident in another manner and the involvement of other people cannot as well be ruled out.
The bench comprising Justice Ramesh Sinha and Justice Dinesh Kumar Singh stated that, the prosecution had failed to prove the case against the couple by evidence beyond any reasonable doubt. Also adding that the victims, aged 25, 35, 55 years could not have been killed in the cold blooded manner single handedly by one person, i.e the accused.
